1. Acceptance of Terms

By using any tool, desktop app, or extension provided by CatalystPack Studio, including “InsightExporter”, “InsightHub (Intelligent Assistant for YouTube Creative Journey Optimization)”, “SmartReplyAssistant”, or “Spotmark”, you agree to be bound by these Terms of Service.

CatalystPack Studio is a digital production studio specializing in productivity tools. These terms govern your access to our website, desktop apps, and browser extensions.

2. Payments, Subscriptions & App Licenses

Our premium features may be provided as subscriptions, one-time app licenses, or other paid plans. Payments may be processed through supported payment providers such as Polar, PayPal, or other available providers.

• Subscriptions automatically renew unless cancelled before the renewal date.
• One-time app licenses do not automatically renew and are subject to the device activation limits shown at checkout or on the pricing page.
• Refunds are handled in accordance with the applicable payment provider’s policies and our current satisfaction guarantee.
• We reserve the right to adjust pricing with prior notice where required.

3. App Licenses & Commercial Use

Spotmark may be sold as a one-time app license rather than a subscription. A lifetime license allows the license holder to use the purchased version of Spotmark without recurring subscription fees, subject to the device activation limits shown at checkout.

The Spotmark Pro Lifetime license is intended for individual use and may be activated on up to 3 devices.

The Spotmark Studio license may be activated on up to 10 devices and permits commercial use, including use in paid client work, monetized videos, courses, livestreams, internal company presentations, and professional training materials.

Commercial use does not allow resale, redistribution, sublicensing, white-labeling, sharing license keys outside the license holder’s team or organization, or using Spotmark as part of a competing product or service.

5. AI Service Usage

Some features utilize Artificial Intelligence (AI) to process data. By using these features, you acknowledge that:

• AI-generated content may occasionally be inaccurate or biased.
• You are responsible for reviewing and verifying any AI output before using it for professional purposes.
• You must comply with the underlying platform terms (e.g., OpenAI, YouTube, or Google) while using our tools.

6. Disclaimer of Warranties & Limitation of Liability

• CatalystPack Studio provides tools on an “as-is” and “as-available” basis. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.
• We are not liable for any direct or indirect damages resulting from the use of our software, including data loss, loss of revenue, or account actions taken by third-party platforms (YouTube, OpenAI, Google, etc.).
• You understand that you use our services at your own discretion and risk.

7. Intellectual Property

All software, designs, and brand assets are the property of CatalystPack Studio. You may not reverse engineer, redistribute, or resell our software without explicit written permission.

8. Changes & Updates

We may update these terms to reflect new features or legal changes. Continued use of our tools after such updates constitutes your acceptance of the new terms.

9. Maintenance & Bug Fixes

• As an independent studio with limited resources, we address bug reports on a priority and best-effort basis. We do not guarantee immediate resolution for all reported issues.
• If a critical bug significantly impacts your paid plan or app license and cannot be fixed promptly, we may offer refunds, subscription extensions, or another reasonable remedy to ensure fairness.
